SF To Propose Bill To Revolutionise The Way Courts Handle Tracker Mortgage Scandal

Sinn Fein is to propose a Bill to revolutionise the way that courts handle cases such as the tracker mortgage scandal.

The Bill proposed by Justice spokesperson Donnchadh Ó Laoghaire would allow collective lawsuits to be taken in instances of wrongdoing.

It is to be voted on by all Deputies in the Dáil on Thursday, 16 November.

Deputy Ó Laoghaire said: "I believe that we will have taken a significant step towards a fairer, more equitable Justice system if we pass this Bill.


"This legislation is a potential game changer in how the courts deal with cases where large categories of people are affected by a particular injustice or inequity, and share a common issue of fact or law; and has a very wide potential application.

"We are far behind comparable jurisdictions in not having an avenue to justice like this.

"It would have a similar effect and impact as processes such as the Class Action in the United States, or the Group Legal Order in Britain.

"There are many people out there, who are the victims of injustices, and who would have an actionable case, but the cost of taking it on themselves makes it effectively impossible.

"This bill brings access to justice within their grasp."
