Officers of the Northern Ireland Environment Agency visited a site at 18 Balloo Avenue, Bangor, where a quantity of controlled wastes in the form of scrap metal and end of life vehicles and parts of end of life vehicles was deposited. The site was operating as a scrap metal site and vehicle breaking yard. Mr Orchard was the registered owner of the site and operator of the scrap metal part of the site. The site did not have a licence to operate as an authorised treatment facility for end of life vehicles or a licence to keep scrap metal.

Mr Orchard pleaded guilty to two waste charges under The Waste and Contaminated Land (Northern Ireland) Order 1997. He was fined £500 under Article 4(1)a and £300 under Article 4(1)b of The Waste and Contaminated Land (Northern Ireland) Order 1997 and ordered to pay court costs of £34.
