In September 2009, Mr McComiskey was found guilty by a jury on two counts of breaching the Waste and Contaminated Land Order (NI) 1997.

During several visits to the site, officers from the Northern Ireland Environment Agency visited Mr McComiskey's land and calculated that around 11,000 tonnes of controlled waste had been illegally deposited in a disused sand pit.
Mr McComiskey must pay the order by March 2013 or face a default prison sentence of 12 months.
